Crosscheck — Terms of Use

The agreement between you and GJU Software LLC

Last updated 16 October 2026

Version 2026-11. These Terms of Use take effect on 16 October 2026. Section 34 explains how they change and which version applies to what.

These Terms of Use ("Terms") are a legal agreement between you and GJU Software LLC, a Florida limited liability company doing business as Crosscheck ("Crosscheck," "we," "us" or "our"). They govern your use of the Service described in Section 1.2. Please read them carefully. If anything in them is unclear, email support@crosscheckmed.com before you agree.

Key points. This summary is only a guide. The numbered sections below are the agreement.

  • You must be 18 or older and able to form a binding contract where you live (Section 2).
  • Crosscheck is a record-keeping and reference tool. It is not medical advice, not legal advice and not the FAA. You remain responsible for your medical certification and for everything you tell the FAA (Sections 4 and 5).
  • A paid plan renews automatically until you cancel. A plan bought on our website can be cancelled online at any time, and we email you before each yearly renewal (Sections 9 and 10). A plan bought in the Crosscheck app is billed by Apple and cancelled in your Apple account settings (Section 9.8).
  • There is no arbitration clause and no class-action waiver. Florida law applies, and cases are heard in Florida courts, except small claims court where you live and any right your home state gives you to sue there. Where the law allows, you and we each give up a jury trial (Section 32).
  • Our liability is limited (Sections 28 and 29). Section 31 says where some of those limits do not apply.

1. About these Terms

1.1 Who we are. The Service is provided by GJU Software LLC, a Florida limited liability company, 7901 4th St N #36361, St. Petersburg, FL 33702, USA. You can reach us at support@crosscheckmed.com or by telephone at (954) 569-6920.

1.2 What these Terms cover. These Terms apply to the website crosscheckmed.com and every page, tool and account feature on it; the Crosscheck app for iPhone and iPad; the Crosscheck Fill-in browser extension and the app that carries it on Apple devices; the emails and text messages we send you; and any other product or service of ours that links to these Terms (together, the "Service").

1.3 How you accept these Terms. You accept these Terms when you tick the box that reads "I am 18 or older and I agree to the Terms of Use" and create an account. If you use parts of the Service that need no account, these Terms apply to that use, and by using those parts you accept them, except that the choice of courts in Section 32.3 and the jury-trial waiver in Section 32.4 apply to you only once you have accepted these Terms by ticking that box. If you buy a Paid Plan, you also accept the Checkout Terms (Section 9.4). If you do not agree to these Terms, do not use the Service.

1.4 The privacy documents are separate from these Terms. Our Privacy Policy and our Consumer Health Data Privacy Policy explain how we handle personal information and consumer health data. When you create an account you confirm, in its own box, that you have read the Privacy Policy, and you give your consent under the Consumer Health Data Privacy Policy in another box. Those two documents are not part of these Terms and are not contracts. Nothing in these Terms reduces any right the law gives you over your information.

1.5 Sections to read with particular care. Section 9.3 (automatic renewal), Section 28 (disclaimers), Section 29 (limitation of liability), Section 30 (indemnity) and Section 32 (disputes, including the waiver of a jury trial) affect your legal rights.

1.6 Words used in these Terms.

  • "Crosscheck" also means the Service where the context is the product.
  • "Account" means your Crosscheck account.
  • "Your Content" means everything you enter, upload or send through the Service, including your records, your documents, your messages to us and any review you write.
  • "Paid Plan" means Crosscheck Plus or Crosscheck Pro, billed monthly or yearly.
  • "Billing Period" means the month or the year that one payment for a Paid Plan covers.
  • "Renewal Date" means the first day of the next Billing Period, when the next payment is due.
  • "FAA" means the Federal Aviation Administration.
  • "AME" means an FAA Aviation Medical Examiner (an "examiner").
  • "Including" means "including without limitation".

2. Who may use Crosscheck

2.1 Age. To create an Account or buy a Paid Plan you must be at least 18 years old and legally able to form a binding contract where you live. The Service is not directed to children. If we learn that an Account belongs to someone younger, we will close it and delete its information as the Privacy Policy describes.

2.2 Capacity. You must be able to form a binding contract, and you must not be barred from using the Service under any law that applies to you.

2.3 The United States. The Service is designed for people in the United States and is operated from the United States. If you use it from elsewhere, you do so on your own initiative and are responsible for following the law where you are.

2.4 Sanctions and export control. You may not use the Service if you are located in, or ordinarily resident in, a country or region that is subject to comprehensive U.S. sanctions, or if you are named on, or owned or controlled by anyone named on, a U.S. government list of sanctioned or restricted parties. You may not use the Service in breach of U.S. sanctions or export control laws.

2.5 Your own records only. An Account belongs to one person and is for that person's own records. You may not use the Service to keep records about anyone else, or to keep records for a health care provider, a health plan, an employer, a flight school or any other organization.

3. What Crosscheck is

3.1 The Service. Crosscheck helps pilots keep their own FAA medical records in order and find what the FAA has published. Depending on your plan, it includes:

  • tools anyone can use without an Account: Check a medication, Check a condition, the FAA guide, Help, and Find an examiner, with the reviews and typical prices other pilots have reported;
  • with a free Account: your medical details, the dates worked out from them, an automatic reminder email before your medical privileges end, and saved examiners;
  • with a Paid Plan: further record areas (for example doctor visits, medications, documents and your answers for MedXPress), reminders you set by email or by text, Crosscheck Fill-in once it is available in your browser's store, and, with Pro, the Certification Assistant and its submission packet.

What each plan includes, and its limits, are shown on our Pricing page at crosscheckmed.com/pricing and again before you pay.

3.2 Sources and dates. Where the Service shows what an FAA document says, it names the document and shows the document's date and the date we last checked it. The FAA's own document is always the one that counts.

3.3 Dates worked out from your details. The Service works out dates, such as when the privileges of each class of your medical certificate end, from the details you enter and the FAA's published rules. Those dates are only as accurate as the details you enter, and they are not an FAA determination.

4. What Crosscheck is not

4.1 Not medical advice. Crosscheck does not give medical advice, diagnose anything or recommend treatment, and it does not tell you what to take or what to stop taking. Using it does not create a doctor–patient relationship or any other health care relationship. Talk to your own doctor about your health.

4.2 Not legal advice. Crosscheck does not give legal advice, and using it does not create an attorney–client relationship.

4.3 Not the FAA. Crosscheck is not affiliated with, endorsed by or acting for the FAA or any other government agency. Nothing in the Service is an FAA determination, and Crosscheck has no part in, and no influence over, any decision about your medical certificate.

4.4 No predictions. Crosscheck does not say whether a medical certificate will be issued, renewed, deferred or denied, or how long anything will take. Nothing in the Service is a prediction of an outcome.

4.5 Your answers are yours. The Service shows where the FAA's forms ask about a topic, and Crosscheck Fill-in can type answers you have saved into MedXPress when you ask it to (Section 17). Crosscheck never chooses your answers and never suggests leaving anything out. The Service is built on the assumption that you report everything the FAA asks about.

4.6 Not an examiner, and not for emergencies. Crosscheck does not replace your AME, and it is not an emergency service. In an emergency, call 911 or your local emergency number.

5. Your responsibilities as a pilot

5.1 Your certification is your responsibility. You are responsible for:

  • holding a valid medical certificate whenever the FAA's rules require one;
  • knowing when its privileges end (see 14 CFR 61.23); and
  • not acting as pilot in command, or as a required pilot flight crewmember, while you know or have reason to know of a medical condition that would make you unable to meet the requirements for your medical certificate (see 14 CFR 61.53).

The dates and reminders in Crosscheck are aids. They do not replace your own checks.

5.2 Truthful and complete answers. You are responsible for everything you tell the FAA, your AME and anyone else, including every answer on your MedXPress application, whether you type it yourself or Crosscheck Fill-in types it for you. Federal law makes a knowingly false or fraudulent statement to the FAA a serious matter (see 18 U.S.C. § 1001 and 14 CFR 67.403).

5.3 Check against the source. Before you rely on anything the Service shows, check it against the FAA document it names, your AME's instructions and any letter the FAA has sent you. If they differ, follow the FAA, your AME and your letter, and please tell us at support@crosscheckmed.com.

5.4 Keep your details current. The dates, reminders and lists the Service shows depend on what you enter. Keep your details accurate and up to date.

6. Your account and its security

6.1 Your Account. Give accurate information when you create your Account, and keep your email address current, because we use it to sign you in, to help you recover your Account and to send you notices (Section 21). An Account belongs to one person. Do not share, sell or transfer it.

6.2 Signing in. You sign in with your email address and password, or with your Apple or Google account if you choose. On Plus or Pro, while records from a paid plan are still kept after it ends, or once you have added a phone to your Account, you also enter a six-digit code we text to your phone each time. The Service signs you out after 15 minutes without activity.

6.3 Keeping your Account secure. Keep your password and your phone to yourself, and do not share a sign-in code with anyone. Crosscheck staff do not need your password or a sign-in code and will not ask for them. You are responsible for activity in your Account that you allow, and for activity that results from your not keeping your password, phone or codes secure. If you think someone else has used your Account, change your password and email support@crosscheckmed.com straight away.

6.4 Getting back in. If you forget your password, you can reset it by email. If you lose the phone that receives your codes, our support team can run an assisted recovery after identity checks and a 24-hour wait, during which we email you a link that stops it. Both depend on access to the email address on your Account. If you sign in with Apple or Google, getting back into that account is done with Apple or Google.

7. Your records and your content

7.1 You own Your Content. As between you and us, you own Your Content. We claim no ownership of it.

7.2 Our permission to use it. You give us a non-exclusive, worldwide, royalty-free license to host, store, encrypt, copy, transmit, back up, process and display Your Content only as needed for these purposes:

  • providing the Service to you, including showing your records on the devices where you sign in;
  • working out your dates;
  • sending the reminders you set and your automatic medical reminder;
  • letting Crosscheck Fill-in type your saved answers into MedXPress when you ask it to;
  • running the Certification Assistant and building your submission packet when you use them;
  • letting you export Your Content;
  • keeping the Service secure, and meeting our legal obligations; and
  • the other purposes the Privacy Policy and the Consumer Health Data Privacy Policy describe. Those policies are not part of these Terms.

This license ends when Your Content is deleted from the Service, except for copies that remain for a limited time in backups and the limited records the Privacy Policy describes. Reviews are covered by Section 19 instead of this section.

7.3 What we do not do with it. We do not sell Your Content. We do not use your health information for advertising or marketing. We do not use Your Content to train artificial intelligence models.

7.4 Encryption. Your records are encrypted and are not available to Crosscheck staff through normal support or administrative tools. Our Security page at crosscheckmed.com/security explains more, including the limits of that protection.

7.5 Your responsibility for Your Content. You are responsible for Your Content, and you confirm that you have the right to upload it. Upload only documents and information about yourself. Do not upload anything unlawful, or anyone else's health information without their permission.

7.6 Keep your own copies. We take care to keep your records available, but the Service is not an archive of record. Keep your own copies of documents that matter to you, such as letters from the FAA. You can export your records at any time from Settings and my data, and download your documents from My documents.

8. Privacy and your health information

8.1 Where it is explained. How we collect, use, share and protect personal information is explained in our Privacy Policy at crosscheckmed.com/privacy. How we handle consumer health data, and the consent you give for it, is explained in our Consumer Health Data Privacy Policy at crosscheckmed.com/health-data-privacy.

8.2 Your health-data consent is separate. You give your consent to Crosscheck storing and using the health information you enter in its own box when you create an Account. It is separate from your acceptance of these Terms, and you can withdraw it as the Consumer Health Data Privacy Policy explains. Without it we cannot keep health records for you, but you can always export and delete what you have stored.

8.3 Optional choices. Marketing emails, news and updates, reminder texts and publishing a review are each a separate choice. None of them is a condition of using the Service.

9. Plans, billing and automatic renewal

9.1 Plans and prices. Crosscheck has a Free plan and two Paid Plans, Crosscheck Plus and Crosscheck Pro, each billed monthly or yearly. The current prices, and what each plan includes, are on our Pricing page and are shown again before you pay. Prices are in U.S. dollars. Sales tax may be added where it applies, and is shown before you pay.

9.2 Paying on our website. This Section 9.2, and Sections 9.4 to 9.7, apply to a Paid Plan bought on our website. A Paid Plan bought in the Crosscheck app is covered by Section 9.8. Payments on our website are processed by our payment processor, Stripe, on Stripe's own secure page. We do not receive or store your full card number. By buying a Paid Plan, you authorize us, through Stripe, to charge the payment method you provide for the first payment and for each renewal described in Section 9.3, and you confirm that you are authorized to use that payment method. Keep your payment details current on the Manage my plan page in your Account.

9.3 AUTOMATIC RENEWAL.

YOUR PAID PLAN RENEWS AUTOMATICALLY UNTIL YOU CANCEL. When you buy a Paid Plan, you agree to the following. At the end of each Billing Period, your plan renews for another Billing Period of the same length (a month or a year, as you chose). On or shortly after each Renewal Date, until you cancel, we charge your payment method the regular price for your plan and Billing Period in effect on that date, plus any applicable tax. That is the regular price shown at checkout, unless it has changed as Section 11 describes. If you paid a first-year or other promotional price, your plan renews at the regular price once that promotional price ends, as the Checkout Terms say. There is no minimum term. You can cancel at any time (Section 10). To avoid the next charge, cancel before your Renewal Date. When you cancel, your plan stays active until the end of the Billing Period you have paid for, and it does not renew.

A Paid Plan bought in the Crosscheck app is charged and renewed by Apple, as Section 9.8 describes, instead.

9.4 Before you pay: the Checkout Terms. Before you pay, Crosscheck shows you, in bold:

  • your plan and its price;
  • how often, and on what date, it renews;
  • any first-year or promotional price, and the price that follows it;
  • that the price can change only as Section 11 describes;
  • how to cancel; and
  • our refund rule.

It then asks you to tick a separate box agreeing to the automatic renewal. Stripe's payment page shows the amount and asks you to accept these Terms. The terms shown to you and accepted at checkout are the "Checkout Terms". If the Checkout Terms and these Terms differ about the price, the length of a Billing Period or a promotional price for that purchase, the Checkout Terms apply to that purchase.

9.5 What we send you about your plan.

  • After your first payment, an email confirming your plan, its renewal terms and how to cancel.
  • Before each yearly renewal, two emails, 35 days and 25 days before the Renewal Date, saying when your plan renews, what you will be charged and how to cancel before then.
  • If you pay monthly, one email a year, about 32 days before the start of each new year of your subscription, reminding you of your plan, its price and how to cancel.
  • With each payment, a receipt that states the amount charged and how to cancel.
  • Before a price change, or before a promotional price ends, the notices in Section 11.
  • When you cancel, a confirmation that says when your plan ends.

9.6 Changing plans. You can move between Plus and Pro, or between monthly and yearly billing, on the Manage my plan page in your Account. Before a change is made, that page shows the new plan, its price, how often and on what date it renews, and what you will be charged or credited and when, and asks you to tick a box agreeing to its automatic renewal. The new plan then renews as Section 9.3 describes.

9.7 Failed payments. If a payment fails, Stripe tries again over about two weeks and emails you how to update your payment method. While a payment is failing, the parts of Crosscheck that belong to your Paid Plan become read-only and your own reminders are held, as Section 13 describes. If a later attempt succeeds, they open again. If no attempt succeeds, your Paid Plan is cancelled and ends.

9.8 Plans bought in the Crosscheck app (the App Store). You can also buy a Paid Plan in the Crosscheck app for iPhone and iPad, through Apple's in-app purchase. For a plan bought this way:

  • Apple charges you. The price, the length of each Billing Period and the renewal terms are shown on Apple's purchase sheet before you confirm. Payment is charged to your Apple account when you confirm, under Apple's terms for purchases.
  • It renews automatically until you cancel. It renews for another Billing Period of the same length unless you cancel at least 24 hours before the end of the current one. Apple charges the renewal within the 24 hours before it.
  • You cancel it with Apple. Cancel in your iPhone's or iPad's Settings (tap your name, then Subscriptions) or at apps.apple.com/account/subscriptions. Crosscheck cannot cancel it for you. Your plan stays active until the end of the Billing Period you have paid for.
  • Refunds are Apple's. Apple processes payments for plans bought in the app, so refunds for them are requested from Apple: go to reportaproblem.apple.com, sign in with your Apple Account, choose the Crosscheck purchase and follow Apple's steps, or ask from Apple's purchase receipt email. Apple decides these requests under its own policies, and Crosscheck cannot issue or refuse an App Store refund. Sections 10.3 to 10.5 apply only to plans bought on our website. Where another section of these Terms mentions a refund (such as Sections 21.5, 26.3, 27.4, 27.5 and 34.4), for a plan bought in the app it means a refund requested from Apple in this way. If you have a billing problem with a plan bought in the app, you can also contact us at support@crosscheckmed.com and we will look at it with you. Nothing in this section limits a refund or other right the law gives you (Section 10.6).
  • Deleting your Account does not cancel it. Cancel it with Apple first, or Apple keeps charging you.
  • Changes, failed payments and price changes are Apple's process. You move between plans in Apple's subscription settings or the app's Choose a plan screen. If a payment fails, Apple retries it, and while it is failing the plan's areas are read-only as Section 13 describes. Apple tells you about price changes and asks for your consent where its rules require it.
  • The first-year offer and promotion codes in Section 12 are for our website. Any introductory price Apple shows on its purchase sheet applies as Apple shows it.
  • Everything else is the same. What each plan includes, and what happens when a Paid Plan ends (Section 13), do not depend on where you bought it.

10. Cancelling and refunds

10.1 How to cancel. You can cancel a Paid Plan bought on our website at any time, in either of these ways (a plan bought in the Crosscheck app is cancelled with Apple, Section 9.8):

  • online, in one flow, on the Manage my plan page in your Account; or
  • by email to support@crosscheckmed.com from the email address on your Account, saying that you want to cancel. We cancel your plan and confirm by email.

You never need to call us, answer a survey or listen to an offer in order to cancel. A cancellation email we receive before your Renewal Date counts as on time. If we charge you after it, we refund that charge.

10.2 What happens when you cancel. Your cancellation takes effect at the end of the Billing Period you have paid for. You are not charged again, and your plan stays active until then. We email you a confirmation that says when your plan ends.

10.3 Monthly plans. We do not refund a monthly payment for a month that has already been charged, except as Sections 10.1, 10.5, 11.3, 21.5, 26.3, 27.4, 27.5 and 34.4 provide or the law requires.

10.4 Yearly plans. If you ask by the end of the third calendar day after any yearly charge, whether it was your first payment or a renewal, we refund that charge in full. The days are counted in your reminder time zone, or in Coordinated Universal Time (UTC) if you have not set one. To ask, use Cancel and refund on the Manage my plan page in your Account, or email support@crosscheckmed.com from the email address on your Account. When we refund a yearly charge, the plan it paid for ends when the refund is made. After that third day we do not refund a yearly payment, except as Sections 10.1, 10.5, 11.3, 21.5, 26.3, 27.4, 27.5 and 34.4 provide or the law requires.

10.5 Other refunds.

  • Deleting your Account cancels a Paid Plan bought on our website, usually within a day. If a renewal is charged in that time, we refund it. It does not cancel a plan bought in the Crosscheck app (Section 9.8).
  • If either of the two renewal notices described in Section 9.5 was not sent to you before a yearly renewal, and you ask within 30 days after that renewal charge, we refund that charge in full and end the plan.
  • Refunds are made to the original payment method. Your bank may take several days to show them.

10.6 Your rights under the law. Nothing in this section limits a cancellation or refund right that the law where you live gives you.

11. Price and renewal-term changes

11.1 Prices change only going forward. We may change the price of a Paid Plan. A new price never applies to a Billing Period you have already paid for.

11.2 Notice of a price change. We email you at least 10 days, and no more than 30 days, before the first charge at a new price. The email states the new price, the date it first applies and how to cancel before then. For a yearly plan, we tell you in the renewal notice sent 25 days before the Renewal Date. If you do not cancel, the new price applies from that Renewal Date. For a plan bought in the Crosscheck app, Apple tells you about a price change instead (Section 9.8).

11.3 Cancelling after a higher charge. If you are charged a price we raised under Section 11.1 for the first time, and you cancel within 14 days after that charge, we refund the unused part of that Billing Period, counted in days. This section does not apply when a first-year or promotional price ends as the Checkout Terms said it would; Section 11.4 covers that.

11.4 When a promotional price ends. When a first-year or other promotional price ends, your plan renews at the regular price, as the Checkout Terms said. For a yearly plan, the renewal notices in Section 9.5 say so in bold type. For a monthly plan whose promotional price lasts longer than one month, we email you 15 to 21 days before the first charge at the regular price.

11.5 Other changes to how your plan renews. If we make any other material change to how your Paid Plan renews, we tell you by email before the change takes effect, with how to cancel.

12. Promotions, the first-year offer and examiner codes

12.1 The first-year offer. While we offer it, a first yearly subscription receives a discount on its first yearly payment, applied for you on the payment page. It is for a first subscription only, once per Account, and only with yearly billing. Your plan then renews at the regular yearly price. We may stop offering it to new subscribers at any time. Stopping it does not change a purchase already made.

12.2 Promotion codes. You can enter a promotion code before you pay, or later on the Manage my plan page in your Account for a coming renewal. A code gives the discount, for the length of time, that is shown when you enter it. A code you bring replaces the first-year offer. Codes have no cash value, cannot be exchanged for cash or combined with another discount, and may have an end date, a limit on uses and other conditions, which are shown with them. We may refuse or cancel a code that was obtained or used fraudulently or in breach of these Terms. When the discount ends, your plan renews at the regular price (Section 11.4).

12.3 Codes from examiners and partners. Some AMEs share a code that gives their patients a discount. A code that names an examiner is used only with that examiner's permission. Crosscheck does not pay any AME or other physician for sharing a code or for referring patients. Some partners who are not physicians, such as flight schools, flight instructors, aviation creators and pilot groups, may be paid for each use of their code. We require partners we pay to say clearly that they are paid, and we check that they do. A code never affects whether a review is published, an examiner's rating or typical price, or the order in which examiners are shown. An examiner or partner is told only how many people used their code, never who, and an examiner is told only once at least three people have used it.

13. The Free plan, and when a Paid Plan ends

13.1 The Free plan. The Free plan has no charge and no end date. What it includes is shown on the Pricing page. We may change what the Free plan includes. If we remove something from it, we will tell you first.

13.2 While a payment is failing, and after a Paid Plan ends. While a payment for your Paid Plan is failing, and after a Paid Plan ends (because you cancelled and the Billing Period ran out, because a charge was refunded, or because a payment could not be collected):

  • the areas of Crosscheck that belong to that plan become read-only: you can open, export and delete what is in them, but you cannot add to them or change them;
  • your documents can still be opened and deleted;
  • the Certification Assistant does not open without Pro, but its plans stay in your export, and they are deleted if you delete your records in Settings and my data or when Section 13.3's 12 months end;
  • while a payment is failing, your own reminders are held and are not sent, and if the payment then succeeds they go out again as the reminder screens describe;
  • when a Paid Plan ends for good, your own reminders are cancelled; and
  • your automatic medical reminder and the other features of the Free plan keep working.

13.3 Records in the paid areas are deleted 12 months after a Paid Plan ends. When a Paid Plan ends for good (Section 13.2; a payment that is still being retried does not end it), the records in the areas of Crosscheck that belong to Paid Plans are kept, read-only, for 12 months from the day the plan ended, and then deleted. Those areas are your doctor visits, medications, documents and their files, MedXPress profile, Certification Assistant plans and FAA letters, and your own dates and reminders. We email you 60, 30 and 7 days before that date, naming it. Until then you can open, export and delete those records, and if you start a Paid Plan again before that date, nothing is deleted. Your medical details, your exam-prep progress, your automatic medical reminder and the rest of the Free plan are never deleted by this, and deleting your Account still deletes everything at once.

14. Reminders

14.1 What reminders there are. On a Paid Plan you can set reminders for dates in your records, to come by email or, if you turn reminder texts on, by text (Section 16), on the day and at the time you choose, in your reminder time zone. On every plan, once you add your medical details, Crosscheck sends you an automatic medical reminder: one email on the 1st of the month in which your medical privileges end, naming your medical class and the date those privileges end. It is set while your records are open, after you add or change your medical details, and only if that 1st of the month is still ahead then. It is on unless you turn it off in Settings and my data.

14.2 What a reminder says. A reminder email or text says that you have an upcoming Crosscheck date and gives the date. It does not say what the date is for. The automatic medical reminder also names your medical class.

14.3 Reminders are a convenience. A reminder can arrive late, land in a spam folder or not arrive at all, for example because of a problem with an email or mobile provider, a wrong address or number, a date entered incorrectly, a failed payment or a fault in the Service. We do not promise that any reminder will arrive, or arrive on time. You remain responsible for knowing and meeting your own medical dates (Section 5.1).

15. Emails we send you

15.1 Service emails. We send emails that are part of the Service, such as sign-in and security notices, notices about your records and your Account, reminders, receipts and renewal notices, notices of changes to these Terms or to our privacy documents, and replies to your messages. While you have an Account you cannot turn these off, except your reminders and your automatic medical reminder.

15.2 Marketing emails, and news and updates. These are separate and optional. We send them only if you choose them, and you can unsubscribe at any time from the link in any of those emails or in Settings and my data. They are never chosen or written from your records.

16. Reminder texts (SMS terms)

Crosscheck reminder texts is an optional text-message program from GJU Software LLC, the company that runs Crosscheck. It texts you about dates you set reminders for in Crosscheck. They are reminders about your own dates, not advertising. Reminder texts are part of the Paid Plans.

Turning them on. In Settings and my data, by ticking a box that starts empty. It is optional. Crosscheck works the same without it, and accepting these Terms does not turn texts on.

Where they go. Only to the phone you sign in with, which you confirmed by entering a code we texted to it, and only if it is a number in the United States, Puerto Rico, the U.S. Virgin Islands, Guam or American Samoa. Texts come from (571) 714-8044. Your sign-in codes come from a different number.

What you get. One text confirming that reminder texts are on. After that, a text on the day and at the time you set, in your reminder time zone, for each reminder you choose to have texted. It gives the date and asks you to sign in at crosscheckmed.com to review the details. It does not say what the date is for. We also answer HELP, STOP and START, and if you turn texts off in Settings and my data or through support, you may get one last text saying they are off.

How often. These are recurring texts. Message frequency varies with the reminders you set.

Cost. Message and data rates may apply.

Stopping them. Reply STOP to (571) 714-8044 at any time. END, CANCEL, UNSUBSCRIBE, QUIT, STOPALL, REVOKE and OPTOUT work the same way, and so does a reply such as "please stop texting me". You can also turn them off in Settings and my data, or ask support. Changing your phone number turns reminder texts off.

Getting them back. Turn them on again in Settings and my data. If you replied STOP, also text START (or YES or UNSTOP) to (571) 714-8044. None of these on its own turns reminder texts back on.

Help. Reply HELP to (571) 714-8044, or email support@crosscheckmed.com.

Delivery. Carriers are not liable for any delayed or undelivered messages. A text can arrive late or not at all, for example when your phone is switched off, and we do not promise when one arrives.

Your privacy. We do not sell or share your mobile number or your agreement to these texts with third parties or affiliates for marketing or promotional purposes. Your agreement covers Crosscheck reminder texts only, and it does not let anyone else text you. How we handle your phone number and your agreement to these texts is set out in our Privacy Policy.

17. Crosscheck Fill-in

17.1 What it is. Crosscheck Fill-in ("Fill-in") is an optional browser extension made by Crosscheck, for Google Chrome and for Apple's Safari, once it is available in your browser's store. It is part of the Service, and these Terms apply to it. Using it needs a Paid Plan that includes My MedXPress Profile.

17.2 What it does. When you press Start filling MedXPress and confirm in Fill-in's own window, Fill-in types the answers you saved in My MedXPress Profile into your own MedXPress application, one page at a time from General to Medical Visits, and stops when it reaches Declarations, when you press Stop, or after 60 minutes. It fills only empty boxes. As it goes, it presses MedXPress's Add button for each medication or visit, clicks each Yes you chose on Medical History and types your explanation, and presses MedXPress's Next after each page. Pressing Add, Yes and Next sends those pages to the FAA's MedXPress system. After you submit your application, Fill-in reads your MedXPress confirmation number and its dates from MedXPress's page and gives them to Crosscheck to keep with your records.

17.3 What it never does. Fill-in never signs or submits your application. It leaves your Social Security number, your declaration, the Submit button and every other MedXPress control to you.

17.4 Your responsibilities. Use Fill-in only on your own MedXPress application. Check every page and every answer in MedXPress before you submit, and correct anything that is wrong. You, not Crosscheck, are responsible for everything your application says and for submitting it (Section 5.2). The FAA can change MedXPress at any time, which can make Fill-in put an answer in the wrong place or stop working, so we do not promise that it will fill every page correctly. You can press Stop at any time.

17.5 MedXPress belongs to the FAA. MedXPress is a U.S. government system operated by the FAA under its own terms, which you must follow. Crosscheck is not affiliated with the FAA, and Fill-in is not an FAA product.

17.6 License. Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable license to install and use Fill-in on devices you own or control, for your own MedXPress application. You may not copy, modify, distribute or sell Fill-in, or reverse engineer it except where the law allows that despite this restriction.

17.7 App stores. If you get Fill-in from the Chrome Web Store or Apple's App Store, that store's own terms also apply to the download. Google is not a party to these Terms and has no responsibility for Fill-in. Section 33 applies to anything you get from Apple's App Store.

18. The Certification Assistant and the submission packet

18.1 What it is. With Pro, the Certification Assistant helps you organize what the FAA's published guidance, and any letter the FAA has sent you, says the examiner or the FAA needs for a condition you choose. It can read an FAA letter you add, on your own device, and suggest lines from it for you to review. It can build a submission packet: a document that you prepare, which carries no Crosscheck branding.

18.2 Its limits. The Assistant works from the FAA's published documents and from what you enter and choose. It can be incomplete, out of date or wrong, and it can misread a letter. It does not decide what applies to you. The FAA's letter to you, your AME's instructions and the FAA's current documents always control. You decide what to gather and what to send, and you are responsible for checking every item in your packet before you send it.

18.3 What we send for you. Apart from the MedXPress pages Crosscheck Fill-in sends when you use it (Section 17.2), Crosscheck does not send anything to the FAA, your AME or anyone else on your behalf. You send your packet yourself.

19. Reviews of examiners

19.1 Writing a review is optional. Find an examiner lets you review an AME you have visited. Nothing in the Service works differently if you never write one.

19.2 What is published. A published review shows your rating, your words, the price you paid and whether that price included an EKG, the class of exam, and the month of your visit. It never shows your name, initials, a handle, your Account or an exact date, and nothing on the published page connects two reviews to the same person. Before you send a review, we ask for your agreement to publish it.

19.3 The rules for reviews. A review must describe your own visit, first-hand, honestly and accurately to the best of your knowledge. By sending one, you confirm that it does. A review must not:

  • name or identify any person other than the examiner and their practice, or include anyone else's health information;
  • include contact details or other personal information;
  • be abusive, threatening, harassing, hateful or obscene;
  • advertise anything, or be written in exchange for payment, a discount or any other benefit;
  • be written by the examiner, by someone who works for or with the examiner or is related to them, or by a competitor; or
  • be unlawful, infringe anyone's rights, or break these Terms.

19.4 How we moderate. We read every review before it appears, so nothing is published the moment you send it. We apply the same rules to every review, whether it is favorable or unfavorable, and we never publish, hold back or take down a review because of its rating or because it is negative. We may decline to publish a review, or take a published one down, if it breaks the rules in Section 19.3, if we cannot reasonably tell that it describes a real visit, or if the law requires it or we receive a legal complaint about it that we consider credible. We do not edit a review to change what it says. If someone repeatedly sends reviews that break these rules, we may stop that Account from writing reviews. A pilot stopped from writing can still take down a review of theirs that is on the site.

19.5 Taking your review down. You can take your review down at any time from that examiner's page. It is removed from the Service straight away, although a copy already loaded in someone's browser can take a few minutes to update. A review you take down stays down, and only you, by writing it again, can send it back to be read. We keep the text of a removed review, marked as removed, as the Privacy Policy explains.

19.6 Your license to us. You keep ownership of your review. You give us a non-exclusive, worldwide, royalty-free license to store, reproduce, publish and display it on the Service; to use the price you report, together with other pilots' prices, to work out an examiner's typical price; and to keep the copy described in Section 19.5. Our right to publish your review ends when you take it down. When your review is taken down, its price leaves the typical price within a few minutes.

19.7 Typical prices. An examiner's typical price is Crosscheck's own figure: the middle of the prices pilots have reported. It is shown only once at least three pilots have reported a price.

19.8 Reviews are opinions. Reviews are other pilots' opinions. Crosscheck does not verify or endorse them, the FAA has nothing to do with them, and neither a rating nor a price is a reason to choose or avoid an examiner. Section 28 applies to them in full.

19.9 Independence. Crosscheck pays no examiner for sharing a code or for referring patients, and accepts no payment to publish, hold back, change or remove a review. The codes in Section 12.3 do not affect reviews, ratings, typical prices or the order in which examiners are shown.

19.10 Reporting a review. If you think a review breaks these rules, whether you are the pilot, the examiner or someone else, email support@crosscheckmed.com. We look at each report and act as these rules require. We do not promise a response time.

19.11 Your right to review us. Nothing in these Terms restricts your right to write an honest review of Crosscheck, anywhere.

20. Acceptable use

You agree not to:

  • use the Service to decide what to leave off an FAA form, or to help anyone else do that;
  • use another person's Account, let anyone else use yours, or create Accounts automatically or in bulk;
  • enter information about another person as though it were yours, or impersonate anyone;
  • use Crosscheck Fill-in on anyone else's MedXPress application;
  • copy, scrape or harvest the Service's content, our compilation of FAA guidance, our examiner information or the reviews, in bulk or by automated means, or republish them or use them to build a competing product (the FAA's own documents are public; our selection, arrangement, summaries and data are ours);
  • probe, scan or test the security of the Service, or get around any security measure, rate limit or access control (if you find a security problem, please report it to security@crosscheckmed.com and give us a reasonable time to fix it before you disclose it);
  • reach, or try to reach, data that is not yours;
  • interfere with, overload or disrupt the Service, or introduce malicious code;
  • reverse engineer the Service, except where the law allows that despite this restriction;
  • sell, trade or misuse promotion codes; or
  • use the Service for anything unlawful, fraudulent or harmful, or in breach of sanctions or export control laws.

21. Electronic communications and notices

21.1 Your consent to electronic communications. By creating an Account, you agree that we may give you electronically, rather than on paper, every agreement, notice, disclosure, receipt and other communication about the Service. That includes these Terms and changes to them, the Checkout Terms, purchase confirmations, renewal, price-change and cancellation notices, privacy notices, and any notice of a security incident or data breach that the law allows us to give electronically. This consent covers your whole relationship with us.

21.2 Email is the primary method. You designate the email address on your Account as your primary method of communication with us, including for any notice the law requires us to give you. We may also show notices in the Service. We text you only for reminder texts you turn on (Section 16) and for sign-in codes.

21.3 When a communication is given. An email is given when we send it to the email address on your Account. A notice in the Service is given when it is shown there. Keep your email address current, and check it.

21.4 Paper copies. You may ask for a paper copy of these Terms, our policies, or any notice about your plan, your Account or a change to our documents that we gave you electronically, free of charge, by emailing support@crosscheckmed.com or writing to us at the postal address in Section 39. We can send a copy of a notice for as long as we keep the record of it (Privacy Policy, Section 15); we do not keep the text of other emails.

21.5 Withdrawing your consent. You can withdraw this consent at any time by emailing support@crosscheckmed.com. Because Crosscheck is provided only online, withdrawing it means we can no longer provide your Account. We will give you the chance to export your records, then close your Account and refund the unused part of the current Billing Period of any Paid Plan, counted in days. Withdrawing does not affect communications given before it.

21.6 Changing your email address. To change the email address on your Account, email support@crosscheckmed.com from your current address and we will help you.

21.7 What you need. To receive and keep our communications you need a device with a current web browser, internet access, an email account you can open, and the ability to save or print web pages, emails and PDF files.

21.8 If what you need changes. If what you need to receive our communications changes in a way that could stop you receiving them, we will tell you, and you may withdraw this consent free of charge.

22. Crosscheck's intellectual property, and FAA material

22.1 What is ours. The Service, including its software, design, text, graphics and icons, our selection and arrangement of FAA material, our summaries and plain-English explanations, our examiner information, and our names and logos, belongs to GJU Software LLC or its licensors and is protected by law. "Crosscheck" and our logos are our trademarks. Do not use them without our permission, except to refer to us accurately.

22.2 Your license to use the Service. Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial purposes. We reserve every right we do not expressly grant.

22.3 FAA material. Works of the U.S. government, including the FAA's own documents, are generally not protected by copyright in the United States (17 U.S.C. § 105). We claim no copyright in the FAA's text. Our rights cover what we add to it.

22.4 Open-source software and map data. Parts of the Service use open-source software and map data under their own licenses, which apply to those parts and are credited where they appear.

23. Feedback

If you send us ideas, suggestions or other feedback about the Service, you give us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, copy, change and build on it for any purpose, without paying or crediting you. You keep any rights you have in it, and you remain free to share it with anyone else. This section does not apply to Your Content or to reviews, which Sections 7 and 19 cover, and it does not limit your right to review Crosscheck (Section 19.11).

24.1 Notices. If you believe material on the Service infringes your copyright, send our designated agent a written notice. These are the elements 17 U.S.C. § 512(c)(3) lists:

  • a physical or electronic signature of a person authorized to act on behalf of the owner of the copyright said to be infringed;
  • identification of the copyrighted work said to be infringed or, if several works are covered by one notice, a representative list of them;
  • identification of the material said to be infringing, with information reasonably sufficient for us to find it on the Service;
  • information reasonably sufficient for us to contact you, such as your address, telephone number and, if you have one, your email address;
  • a statement that you have a good-faith belief that the use of the material in the way complained of is not authorized by the copyright owner, its agent or the law; and
  • a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the copyright said to be infringed.

When we remove material because of a notice, we tell the person who posted it.

24.2 Counter-notices. If material you posted was removed because of a notice and you believe that was a mistake or a misidentification, you may send our designated agent a counter-notice. These are the elements 17 U.S.C. § 512(g)(3) lists:

  • your physical or electronic signature;
  • identification of the material that was removed and where it appeared before it was removed;
  • a statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification; and
  • your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or their agent.

We send a copy of any counter-notice, including your name and contact details, to the person who sent the original notice. Unless that person tells us that they have filed a court action, we restore the material no less than 10 and no more than 14 business days after we receive your counter-notice.

24.3 Repeat infringers. We will close, in appropriate circumstances, the Account of anyone who repeatedly infringes copyright.

24.4 False notices. Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages.

24.5 Our designated agent.

  • Name or title: Copyright Agent
  • GJU Software LLC, 7901 4th St N #36361, St. Petersburg, FL 33702, USA
  • Telephone: (954) 569-6920
  • Email: support@crosscheckmed.com, with "Copyright notice" in the subject line

This agent is registered in the U.S. Copyright Office's DMCA Designated Agent Directory under number DMCA-1082431.

25. Third-party services and sites

The Service works with, and links to, services that other companies and agencies run, including the FAA's MedXPress system and website, Stripe's payment pages, Apple's and Google's sign-in pages, the Chrome Web Store and Apple's App Store, email providers and mobile carriers. Those services are not ours, their own terms and privacy policies apply to them, and a link to one is not an endorsement. To the extent the law allows, we are not responsible for them or for anything they do.

26. Private preview and changes to the Service

26.1 The private preview. Until 10 October 2026 the Service was in a private preview behind a shared password. The preview has ended.

26.2 Changes to the Service. We may add, change or remove features, and correct or update what we publish. When the FAA changes a document, we update what we show and the dates beside it.

26.3 Removing a paid feature. If we remove a feature that your Paid Plan was sold with during a Billing Period you have paid for, you may cancel and receive a refund of the unused part of that Billing Period, counted in days.

26.4 Availability. We work to keep the Service available, but we do not promise that it will be available without interruption. Maintenance can happen without notice. Your records can be temporarily unavailable while Crosscheck finishes a security update.

27. Suspension and closure

27.1 By you. You can stop using the Service at any time. You can delete your Account on Account & privacy. Deleting your Account takes effect straight away, cancels any Paid Plan (Section 10.5), and is described in the Privacy Policy, including the limited records that remain afterwards.

27.2 By us. We may suspend or close your Account, or stop it writing reviews, if:

  • you seriously or repeatedly break these Terms;
  • you use the Service unlawfully or fraudulently;
  • your use creates a risk to the security or operation of the Service or to other people;
  • the law requires us to;
  • you are not eligible to use the Service (Section 2); or
  • we stop providing the Service (Section 27.5).

27.3 Notice, and your records first. Before we close your Account, we will tell you why and give you at least 30 days to export your records, unless the law prevents it, the Account belongs to someone who does not meet Section 2.1, or there is an immediate risk to the security of the Service or to other people. Even then, we will give you a way to export your records where we lawfully and safely can.

27.4 Refunds when we close an Account. If we close the Account of someone with a Paid Plan for a reason other than their breach of these Terms or unlawful use, we refund the unused part of the current Billing Period, counted in days.

27.5 If we stop providing the Service. If we decide to stop providing the Service altogether, we will tell you at least 30 days before, give you time to export your records, and refund the unused part of the current Billing Period of any Paid Plan, counted in days.

27.6 What ends. When your Account is closed, your licenses under these Terms end. Section 37 lists what continues.

28. DISCLAIMERS

EXCEPT AS THESE TERMS EXPRESSLY STATE, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE, INCLUDING CROSSCHECK FILL-IN, THE CERTIFICATION ASSISTANT, REMINDERS AND ALL CONTENT, IS PROVIDED "AS IS" AND "AS AVAILABLE", AND WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE PARAGRAPH ABOVE, WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE OF ERRORS; THAT ANY INFORMATION IN IT, INCLUDING WHAT IT SAYS THE FAA HAS PUBLISHED, IS COMPLETE, CURRENT OR ACCURATE; THAT ANY DATE IT WORKS OUT IS CORRECT; THAT ANY REMINDER, EMAIL OR TEXT WILL ARRIVE, OR ARRIVE ON TIME; THAT CROSSCHECK FILL-IN WILL FILL ANY PAGE CORRECTLY; OR THAT THE CERTIFICATION ASSISTANT WILL IDENTIFY EVERYTHING THE FAA OR AN EXAMINER NEEDS. THE FAA'S OWN DOCUMENTS, ANY LETTER THE FAA SENDS YOU AND YOUR AME'S INSTRUCTIONS ALWAYS CONTROL.

REVIEWS AND TYPICAL PRICES ARE OTHER PILOTS' OPINIONS AND REPORTS. WE DO NOT VERIFY OR ENDORSE THEM.

Some states do not allow implied warranties to be disclaimed, or limit how they may be. Section 31 says where this section does not apply. This section does not affect any warranty that cannot be excluded under the law that applies to you.

29. LIMITATION OF LIABILITY

29.1 TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER GJU SOFTWARE LLC NOR ITS MEMBERS, MANAGERS, EMPLOYEES OR AGENTS WILL BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, INCOME, EMPLOYMENT, FLYING PRIVILEGES OR OPPORTUNITIES, OR DATA, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER THE CLAIM IS BASED ON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STATUTE OR ANY OTHER LEGAL THEORY, AND EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.

29.2 TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, ON ANY LEGAL THEORY, IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, AND (B) ONE HUNDRED U.S. DOLLARS (US$100).

29.3 What this section does not limit. Nothing in these Terms excludes or limits our liability for fraud or fraudulent misrepresentation; for our gross negligence or our willful or intentional misconduct; for death or personal injury caused by our negligence; for any refund we have agreed or are required to make; or for anything else that cannot be excluded or limited under the law that applies to you.

29.4 Why these limits exist. The disclaimers in Section 28 and the limits in this section are part of the basis on which we offer the Service at its price, including the Free plan. Section 31 says where some of them do not apply.

30. Indemnity

To the extent the law allows, you agree to indemnify GJU Software LLC and its members, managers, employees and agents against claims made by third parties arising out of (a) Your Content, including any review you publish; (b) your misuse of the Service, including using Crosscheck Fill-in on anyone else's application; or (c) your breach of these Terms or of the law. For such a claim, you will pay the amounts finally awarded against us by a court, or agreed in a settlement you have approved. This section does not apply to any claim to the extent it is caused by our own negligence, misconduct or breach of these Terms. We will tell you promptly about any such claim. We will control its defense at our own cost, and you may take part with your own lawyer at your own cost. We will not settle a claim in a way that requires you to admit fault or to pay anything without your written agreement.

31. State-specific terms

31.1 New Jersey. If you are a New Jersey resident: (a) the exclusion of punitive damages in Section 29.1 does not apply to you; (b) Section 29 does not limit our liability for our negligence, or for any claim you have under the New Jersey Consumer Fraud Act; (c) the indemnity in Section 30 does not apply to you; and (d) the disclaimer of implied warranties in Section 28 does not apply to you.

31.2 California. If you are a California resident: nothing in these Terms exempts us from responsibility for our own fraud, our willful injury to the person or property of another, or our violation of law (California Civil Code § 1668); nothing in these Terms waives any right you have under the Consumers Legal Remedies Act (California Civil Code § 1750 and following), including any right to bring a class action under it; nothing in these Terms waives your right to seek public injunctive relief; and the jury-trial waiver in Section 32.4 does not apply to you. Under California Civil Code § 1789.3, California users are entitled to the following notice. The Service is provided by GJU Software LLC, 7901 4th St N #36361, St. Petersburg, FL 33702, USA, telephone (954) 569-6920. Its charges are those shown on our Pricing page and before you pay (Section 9). To resolve a complaint about the Service, email support@crosscheckmed.com, call us, or write to us at that postal address. The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

31.3 Georgia and North Carolina. If you are a Georgia or North Carolina resident, the jury-trial waiver in Section 32.4 does not apply to you.

31.4 Implied warranties in certain states. If you live in Kansas, Maine, Maryland, Massachusetts, Vermont, West Virginia or the District of Columbia, whose laws restrict the disclaimer of implied warranties in consumer transactions, the disclaimer of implied warranties in Section 28 applies to you only as far as your state's law allows.

31.5 Rights that cannot be waived. If the law where you live gives you a right or remedy that cannot be waived or limited by contract, nothing in these Terms waives or limits it.

32. Disputes, governing law and jury trial waiver

32.1 Talk to us first. Before either of us brings a claim in court, the one bringing it will send the other a written notice describing the claim and the remedy wanted, by email to support@crosscheckmed.com or by mail to the address in Section 39 if you are sending it, or by email to the address on your Account if we are. We will both try in good faith to resolve the claim within 60 days after the notice is received. Any time limit for bringing the claim is paused during those 60 days. If waiting would let a time limit expire, either of us may file without waiting. This step does not apply to a claim brought in small claims court, to a request for urgent relief to prevent irreparable harm, or where the law does not allow it to be required.

32.2 Governing law. These Terms, and any dispute arising out of or relating to them or to the Service, are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-laws rules. This choice of law does not take away any protection given to you by a law of the state where you live that cannot be waived by contract.

32.3 Where disputes are heard. Any dispute arising out of or relating to these Terms or the Service will be heard only in the state and federal courts located in the State of Florida, and you and we each consent to the personal jurisdiction of those courts. There are two exceptions. Either of us may bring an individual claim in a small claims court in the county where you live, or in Florida, if the claim qualifies. And if the law of the state where you live gives you a right, which cannot be waived by contract, to bring a claim in the courts of that state, you may bring it there.

32.4 WAIVER OF JURY TRIAL.

WHERE THE LAW PERMITS, YOU AND WE EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY LAWSUIT ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE. THIS WAIVER DOES NOT APPLY WHERE THE LAW DOES NOT PERMIT IT, INCLUDING TO RESIDENTS OF CALIFORNIA, GEORGIA AND NORTH CAROLINA.

32.5 No arbitration and no class-action waiver. These Terms contain no agreement to arbitrate and no waiver of class or collective actions.

32.6 Time to bring a claim. Nothing in these Terms shortens the time the law allows you to bring a claim.

33. Apple-specific terms

This section applies if you got the Crosscheck app for iPhone and iPad, Crosscheck Fill-in, or any other app of ours, from Apple's App Store (an "Apple App"). Plans bought in an Apple App are covered by Section 9.8.

  • These Terms are between you and GJU Software LLC only, not Apple Inc. ("Apple"). We, not Apple, are solely responsible for the Apple App and its content.
  • Your license to use the Apple App is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that it may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
  • We, not Apple, are solely responsible for providing maintenance and support for the Apple App (Section 39). Apple has no obligation to provide any maintenance or support for it.
  • If the Apple App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, that you paid for it. To the maximum extent permitted by law, Apple has no other warranty obligation for the Apple App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, to the extent not effectively disclaimed by these Terms.
  • We, not Apple, are responsible for addressing any claims by you or any third party relating to the Apple App or your possession and use of it, including product liability claims, claims that the Apple App fails to conform to any applicable legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
  • If a third party claims that the Apple App, or your possession and use of it, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
  • You represent and warrant that you are not located in a country that is subject to a U.S. government embargo or that the U.S. government has designated as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
  • Our name, address, telephone number and email address for questions, complaints or claims about the Apple App are in Section 39.
  • When you use the Apple App, you must comply with any applicable third-party terms, such as your wireless data service agreement.
  • Apple and its subsidiaries are third-party beneficiaries of this Section 33, and once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce this Section 33 against you as a third-party beneficiary.

If Apple's Licensed Application End User License Agreement applies to an Apple App, it governs your license to use that app, and these Terms govern everything else.

34. Changes to these Terms

34.1 Changes apply going forward. A change to these Terms applies only from the date it takes effect. A dispute about something that happened before a change is governed by the version of these Terms in effect when it happened. Until you accept a material change, the version you last accepted continues to apply to you, except for changes the law requires.

34.2 Notice of a material change. We will tell you about a material change at least 30 days before it takes effect, by email to the address on your Account and by a notice in the Service, with a summary of what is changing.

34.3 Accepting a change. After a material change takes effect, we ask you to accept the new Terms the next time you sign in, and we record the version you accept and when. Until you accept, your dashboard and your record pages wait, but you can still export your records, delete them, and delete your Account, because agreeing to new wording is never the price of getting your own information out.

34.4 If you do not accept. If you do not accept a material change, you may stop using the Service and delete your Account. If you have a Paid Plan, you may also cancel it and receive a refund of the unused part of the current Billing Period, counted in days, if you ask within 30 days after we first ask you to accept it.

34.5 Other changes. A change that is not material, such as a correction or a clearer wording, takes effect when we post it with a new "Last updated" date. A change that the law requires, or that is needed to deal with a security risk, may take effect sooner than 30 days if necessary, and we will tell you as soon as we can.

34.6 Earlier versions. Earlier versions of these Terms are available on request from support@crosscheckmed.com.

35. Assignment, and events beyond our control

35.1 Assignment. You may not assign or transfer these Terms or your Account. We may assign these Terms as part of a merger, acquisition, reorganization or sale of all or substantially all of our business or assets, if the recipient agrees to be bound by them. We will tell you before that happens. Your agreement to reminder texts covers Crosscheck reminder texts only, and it does not let anyone else text you.

35.2 Events beyond our control. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, such as natural disasters, failures of the internet, power, mobile networks or the cloud services we rely on, government action, war, civil unrest, labor disputes, or attacks on our systems that reasonable security measures would not have prevented. We will take reasonable steps to limit the effect of such an event and to resume the Service. This section does not excuse any refund we owe you.

36. General terms

36.1 Entire agreement. These Terms, together with the Checkout Terms for any purchase, are the entire agreement between you and us about the Service, and replace any earlier agreement or understanding about it. The Privacy Policy and the Consumer Health Data Privacy Policy are not part of this agreement (Section 1.4).

36.2 Which terms apply first. Section 33 applies first to an Apple App. For the price, Billing Period and promotional price of a purchase on our website, the Checkout Terms apply (Section 9.4); for a purchase in the Crosscheck app, what Apple's purchase sheet shows and Section 9.8 apply. Otherwise these Terms apply.

36.3 Severability. If a court finds any part of these Terms invalid or unenforceable, that part will be enforced as far as the law allows, or limited only as much as necessary, and the rest of these Terms stays in effect.

36.4 No waiver. If we do not enforce a part of these Terms, that is not a waiver of our right to enforce it later.

36.5 Our relationship. You and we are independent parties. These Terms do not create a partnership, agency, employment or fiduciary relationship.

36.6 No other beneficiaries. No one other than you and us has any right to enforce these Terms, except Apple under Section 33.

36.7 Interpretation. Headings are for convenience only. Words in the singular include the plural, and the other way round. If these Terms are translated, the English version controls.

36.8 Notices to us. Send notices about these Terms to support@crosscheckmed.com. Send legal notices also by mail to the address in Section 39. Section 21 explains how we send notices to you.

37. Survival

These parts of these Terms continue after your Account is closed or these Terms end: Sections 1.4 and 1.6; Section 5, for what happened before; Sections 7.1 and 7.2, for copies that remain as Section 7.2 describes; Sections 10 and 11, for any refund owed; Sections 19.5, 19.6 and 19.7; Section 21; Sections 22, 23 and 24; Sections 28 to 32; Section 34.1; Sections 35 to 37; and any other part that by its nature should continue.

38. Accessibility

We aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1 at level AA. If any part of the Service is hard for you to use, email support@crosscheckmed.com, and we will help you or give you the information another way.
